The Johor State Constitution governs everything about the running of the state

TWO things are often mentioned by Umno hardliners when asked about the grand old party’s traits. One is that it is united; two is that it is one with the palace.

Nothing could be farther than the truth.

The Barisan Nasional’s second thumping victory was followed by several hours of bragging rights. Only DAP was able to look at its wounds and lick them.

The rest of the Pakatan Harapan coalition members were literally pulverised. Even Perikatan Nasional, the coalition with which some quarters within Umno describe as having an uneasy coalition, was pummelled into the ground.

Among the things claimed by Umno was that it won because it could name its next and 19th Menteri Besar for Johor – Datuk Seri Utama Haji Hasni bin Mohammad.

Hasni was Johor’s 18th Menteri Besar, whose tenure was known for its stability despite having a razor-thin margin over the state’s opposition. Hasni treated all 56 assemblymen equally and even provided equal allocations, other than being a model inclusive leader. Naturally voters would want the same formula to be continued.

The result was the 40-seat victory for Barisan Nasional last Saturday.

Then came the shocking news: the palace wanted another name as the next Menteri Besar – Datuk Onn Hafiz Ghazi.

The 43-year old is the great-great grandson of Johor’s first Menteri Besar, Datuk Jaafar bin Haji Muhammad, and grandson of the 3rd Prime Minister of Malaysia, Tun Hussein bin Datuk Onn.

And what usually comes after shock? Denial, followed by anger. And when Umno supporters get angry, they become irrational, and the anger is then directed towards the Istana for what they deem as “meddling’. But was the palace meddling?

The way I see it is that Umno had committed a mistake by naming a Menteri Besar, turning him into a poster boy, ahead of the palace. As a grand old party, Umno should have known better than to usurp the constitutional right of the Sultan.

Article 3 (1) of the Johor State Constitution (Part 2) states that the Ruler shall appoint in writing, a qualified Malay and Muslim Menteri Besar who meets the prerequisites Article 4 (2) (1) of the said Constitution. This in turn states that the person to become the Menteri Besar has to be a member of the Dewan who, in the Ruler’s judgment, commands the most support of members of the Dewan.

It clearly states there that the prerogative to appoint a Menteri Besar is the prerogative of the Ruler. This is replicated on the Federal level by the Yang di-Pertuan Agong when appointing a Prime Minister (and Chief Ministers, as delegated to the governors). The Ruler is the Chief Executive Officer of the  nation/state while the PM and MB are the Chief Operating Officers. Ours is not a government by the people and for the people. We are not the United States of America.

The PM/MBs are then given the executive powers to administer the Federal/respective State governments on behalf of the Rulers, save for a few provisions, including the choosing and appointing of prime ministers and menteris besar which remain as royal prerogatives. As a word of caution, these prerogatives come with fundamental principles.

The Federal/State Constitution is supreme. Where there is conflict between the Constitution and the royal prerogative, the Constitution prevails. The royal prerogative remains subject to the duties of fairness and reason. And although the prerogatives can be abolished or abrogated, they can only be done with the expressed permission of the Rulers Council.

And Johor isn’t the only state in recent times where the palace has rejected the winning party’s choice of a state COO. Perlis rejected Datuk Seri Shahidan Kassim in 2008 and named Md Isa Sabu instead.

This had put the former at loggerheads with the palace that led to Shahidan’s brother getting rejected in 2018.

Terengganu rejected Datuk Seri Idris Jusoh in 2008, and we saw some banners carried by palace friendly Umno supporters equating the Ruler to animals. Selangor rejected Datin Seri Dr Wan Azizah Wan Ismail in 2014 as its Menteri Besar to replace Khalid Ibrahim as a result of the “Kajang move”; A year before that, the nomination of Datu Husam Musa as a state executive councillor was rejected by the Kelantan palace.

What then is our duty during an election?

Our only duty is to choose, from amongst us, those whom we believe can represent us well in His Majesty’s government. As such, when we complain about stupid politicians having made it into the august house, we only have ourselves as voters to blame.

We put them there, or we did not do enough to prevent them from getting there.

Therefore, coming back to Johor’s predicament, the Ruler has chosen the person who, in the Ruler’s judgment, has the most support of the members of Johor’s Dewan.

Although there is a move by Umno that allegedly has collected 38 signatures from its elected members to support Hasni as Umno’s choice of the incoming MB, that really shows that UMNO or whoever it is behind that move, does not know its or his place. Even Hasni has come out to tell everyone to give this opportunity to his younger successor.

Looking at the bigger picture, the choice of a younger MB for Johor is apt at this juncture given that it is Johor that will ascend the throne of the Yang di-Pertuan Agong in January of 2024.

The Tunku Mahkota of Johor will be acting as the Regent during that period. A young MB will not only be able to match the dynamics of a young Ruler, but also reduces the chances of a senior and more experienced politician who might think that he knows better than the Ruler.

If Umno really has the balls and thinks that it can do without the Ruler’s support and try the Johor’s voters’ resolve, its elected representatives can perhaps try to stage a walkout when Onn Hafiz is being sworn-in to show that he does not have their support.

100 Peratus Kata Pakatan Biasanya Hanya 10 Peratus

Beliau sertakan gambar berikut:

Kalau tengok, memang malang nasib Khaled.

Drama Kera La Sebelum Terhempas

Harapan Yang Berbahaya

Tian Chua memang tidak menghormati penjawat awam

Pakatan Orang-Orang Yang Tidak Menghormati Undang-Undang

Pakatan Can Promise Sarawak The World

The question is, can it even deliver those promises?

In a recent article posted on Tian Chua’s Malaysia-Chronicle, Pakatan made a promise to Sarawakians – a promise that they claim the Barisan Nasional can never match.

If you have problems accessing the website, don’t worry. It has been spread via WhatsApp as usual and the content is as follows:

———————————————-

A DEAL NAJIB CAN NEVER MATCH: SARAWAK TO KEEP 50% TAX REVENUE, 20% OIL & GAS ROYALTY, DECISION & EDUCATION RIGHTS TO BE RETURNED TO STATE GOVT – HARAPAN

Politics | January 20, 2018 by | 0 Comments

Pakatan Harapan’s Sarawak manifesto pledges that the state will retain 50 percent of all tax revenues collected in the state.

The state will also receive 20 percent from oil and gas royalties or its equivalent value from the federal government, according to the manifesto titled ‘New Deal for Sarawak Part Two’, which was released today.

“The government of Sarawak shall use these funds to shoulder the fiscal responsibility of the federal government in education and health,” the manifesto states.

Harapan also promised to set up a Petronas equivalent in the state, to be named Sarawak Petrogas, which would be wholly owned by the state government.

Sarawak Petrogas, which will be directly answerable to the Sarawak legislative assembly, will jointly manage oil and gas resources within the territorial borders and waters of Sarawak, together with Petronas, the manifesto says.

This is similar to Petroleum Sarawak, an oil and gas company started by the current Sarawak state government, which is meant to be an equal partner with Petronas for oil and gas activities in the state.

‘State can localise education syllabi’

With the decision rights returned to Sarawak in education and healthcare, the state can localise the education syllabi, review staffing and administrative policies, improve and upgrade the quality of all hospitals in the state and equip hospitals with cancer and heart centres, among others.

Harapan will also focus on speeding up the supply of clean water and electricity to all houses in Sarawak, both suburban and rural, as well as roads connecting rural native heartlands to stimulate economic growth in the interiors of Sarawak.

It will also ensure top priority is given to competent and eligible Sarawakians for employment and promotion in federal government departments and agencies in Sarawak.

World-class coaching facilities and a sports institute will be developed in Sarawak, the manifesto states, to equip and harness the potential of Sarawakian athletes.

Aside from its commitment to restore Sarawak to its original status within the context of the Malaysia Agreement 1963, Harapan said it would also form a Royal Commission to review various legislations that affect Sarawak’s rights to its natural resources.

These legislations include the Continental Shelf Act 1966, the Petroleum Development Act 1974 and the Territorial Sea Act 2012.

Harapan said Part Three of its New Deal for Sarawak would be released at a later date.

MKINI

—————————————-

Hallelujah!

But before you even start to dance with joy, let me remind you that this is another one of those ad nauseam promises made, which can never be fulfilled, and will later be blamed on the Federal Constitution and the Federal Government.

Pakatan Harapan Sarawak cannot deliver fully on this promise because it is merely a state entity and cannot arrogate to the state what are Federal rights. As usual, Pakatan Harapan will refer to its non-existent utopian Federal Constitution when making such promises.

Even if it is a Pakatan Harapan Federal Government promise, it cannot fully deliver without the consent of the 11 Peninsular Malaysia states and Sabah because the Malaysia Agreement 1963 is an agreement inter se.

Any increase in the rights of one state vis a vis its position with the Federal Government diminishes the position of the other states vis a vis that one state as well as with the Federal Government . It will need the agreement of the other states in the Federation.

Therefore, Pakatan Harapan should stop making false promises and giving the people false hopes just because they (Pakatan Harapan) have false intelligence.

Dunce Accumulating Party – Part 3

Do you still remember Ting Tiong Choon, the Australian with the bak chang face who duped the idiots living in Pujut into voting for him into office last year?

He claims that his removal from the Sarawak State Assembly is a political conspiracy.

Yes, the bak chang-faced Australian claims that it was a political conspiracy that had him ejected as an ADUN.

This conspiracy would have begun eight years before Ah Choon was born. Those who drafted the Federal Constitution knew that Ah Choon would be born in Malaysia on the 31st October 1965, and then apply for a PR status in Australia on 5 May 1994 after entering the country using a student visa on 7 May 1994.

However, he had his application rejected on 3 April 1995. In 2007 and 2008, Ah Choon bought substantial number of properties and set up many companies, and then applied for an Australian citizenship under the INVESTMENT category.

You can read more about it here.

That is how advanced the political conspirators were.

It did not sound as if Ah Choon had Malaysia’s interests at heart, nor the intention to return as a Malaysian to help Sarawakians as claimed.

The moment you take up another country’s citizenship you lose your Malaysian one. It is that simple.

And as a foreigner, you cannot contest in Malaysia’s elections, state or federal.

You cannot contest in Australia too if you are a foreign citizen.

Perhaps Ah Choon cannot read because he is perhaps an Ah Beng.

Or perhaps it is a DAP political conspiracy to field a foreign phantom candidate and then act stupid and lay the blame on the Barisan Nasional.

DAP after all is filled with criminals and lawbreakers.

A Police Report

I lodged a police report today on an exposé made by the DC Leaks not too long ago.

I finally got to read and was alarmed by it yesterday and quickly got in touch with a friend and we decided on lodging a police report

Although I know that the police has begun an investigation into the links, I saw a similar pattern that needs to be investigated. The report among others is to look into the authenticity of the document as well as to enable the police to see the similar patterns and tie them together.

With the help of a good journalist friend we had some journalists covering the ‘event’ and we were fair as we allowed representation from whichever side of the fence to ask questions.

In DC Leaks (photo at the top), there was an internal OSF document where Premesh Chandran was listed as the Chairman of the advisory committee for Malaysia to OSF.

Premesh is the co-founder and current CEO of online portal Malaysiakini. His name appearing in the OSF document suggests that he is, at the time of the document being published, colluding with Soros to bring about a forced and undemocratic change of government.

The document’s title is Shared Frameworks Proposed Contributions to 2014-2017 Strategies. Obviously funds are still coming in to effect change in Malaysia as the previous general elections was in 2013.

And the Malaysian Chair for OSF’s Southeast Asia Initiative is interested in the topic of ‘election integrity.’

OSF documents also show that they admit funding and controlling the International Renaissance Front (IRF) based in Kiev, the capital of Ukraine, which is acknowledged as the key mover to Ukraine’s bloody 2014 revolution.

The 2014 revolution led to hundreds of deaths and missing people in the rallies and led to civil war and breakup of Ukraine – which has killed another 8,000 people and still continuing. This Ukraine was also led to the shooting down of our MH17.
In that same document, it stated that in Malaysia, the Chair of the OSF advisory committee is the founder of MalaysiaKini (which OSF indirectly owns and control 29% shares).

Interestingly, YM Tunku Abdul Aziz also pointed out that the Red Bean Army is also funded by foreigners.

Tunku Aziz, who was DAP national vice-chairman from August 2008 until he resigned in disgust in May 2012 would certainly have detailed inside information of DAP and their RBA.

The DAP has always disassociated itself from the RBA. However, Wechat or whatsapp voice chat admission supposedly from the Kedah DAP Youth Chief Tan Jia Hao (JH Tan) shows an admission that the Red Bean Army (RBA) cybertroopers are indeed DAP and Pakatan’s troops on social media for the purpose of attacking BN supporters which they call Chow Kows or running dogs and will not attack their own people.

The conversation seems to be about Mr Tan clarifying to his friend on why a certain person was attacked by the RBA recently – where he claims that the RBA has caused great harm to that person.

To be fair to all parties, it is imperative that the police probe and investigate these links.

Let me say this: if it is change that you want, do so in a democratic manner. The last thing you should do is to support organisations that are themselves the Chow Kow for foreigners.

That if true, in my opinion, is bordering treason. And I shall not stand and watch my country get run by puppets of foreign powers.

On A Suicide Watch

A month ago in the aftermath of the Sarawak State Elections, Mahathir remarked that the situation for Barisan Nasional were different in Sarawak compared to the Peninsula. Whilst national issues are natural concerns for the Malayans, Sarawakians were more concerned about their well-being. Nary a day passed without Mahathir campaigning against Najib.

This 91-year old thoroughgoing villain pulled out all the stops to have Najib removed albeit undemocratically even to the extent of cooperating with his political enemies, soliciting help from foreigners to throw baseless allegations and lies, as well as coming up with a nonsensical “Citizens Declaration” that was proven to have false signatures.

In the end, the parliamentary by-elections in Sungai Besar and Kuala Kangsar proved that the voters totally rejected the destructive lies brought forth by Mahathir as well as his attempt to make Muhyiddin the Prime Minister to warm up that seat for his son Mukhriz. The opposition paid a heavy price for jockeying this mule when, despite heavy campaigning, they lost badly to Barisan Nasional and made an ass of themselves. That is the price they paid for aligning themselves with Mahathir thinking it would benefit them. Anwar must be smiling to himself in prison.

In 1905, George Santayana wrote “Those who cannot remember the past are condemned to repeat it.” Mahathir was a great man but he was a cruel and egotistical dictator nevertheless. He was rejected by his own UMNO division in 2004. Instead of remembering that episode, the opposition chose to ride on Mahathir’s “popularity.”

Unfortunately for them, most of the voters still remember Mahathir’s sins. This played well into BN’s hands where the backroom boys used to engineer the opposition’s downfall. And being the proud and egotistical person that he is, Mahathir refused to recognise that his campaign was disastrous. Instead of saving his “friends,” he dragged PKR, DAP and PAN deep into the hole that he had himself dug.

It’s a bit like a suicide watch…with a twist.

Honeyed Words, Evil Mind

Persuades the mob, great woes befall the state.”

Baru Bian not looking into the mirror
Baru Bian not looking into the mirror

I was both amused and bemused by Baru Bian’s statement in the papers.  Amused because Baru Bian’s claims seem absurd and bemused because while making the statement, it was obvious Baru never looked into the mirror to reflect upon his own achievements in Ba’ Kelalan – which is close to zero.

Close to zero is what it is.  One of Baru’s recent trips to Ba Kelalan was on the 6th April 2016 which was to SK Ba’ Kelalan in the village of Long Langai to present some books for the schoolchildren.  While that is a good gesture, why has Baru, as the incumbent assemblyman there, turned a blind eye to the condition of the school?  The hostel where the schoolchildren sleep, teachers’ quarters are all in dilapidated condition.  With a limited grant from the State Education department, the school is being kept in operational condition thanks to the hard-working and very dedicated teachers under the leadership of the school’s principal, Puan Bulan Dawat, and the efforts by the parents of the schoolchildren who often provide the manpower to assist the teachers.

In the village of Buduk Nur, the request for chairs for the village’s multi-purpose hall made in 2011 to Baru also fell on deaf ears. “Nanti kita fikirkanlah” (We will think about it later) was what Baru was reported to have said to his voters.  From then until recently, villagers would have to move chairs from the neighbouring church into the hall and back whenever there is a village event held inside the hall.  In these modern days where many of the young adults have almost all moved out of Ba Kelalan for studies or to work, getting the manpower to clean up the hall let alone move chairs and tables back and forth every time they are needed at the hall is not easy.

That has changed.  Inside the multi-purpose hall at Buduk Nur now are two sets of wireless public address systems donated by the current Chief Minister of Sarawak, and chairs and tables bearing the words “Ikhlas dari Pejabat Perdana Menteri” (Sincerely from the Prime Minister’s Office).  Looking at these two gifts, I doubt they cost much – a state assemblyman could easily have afforded to buy these PA system, tables and chairs.  Or he could have gotten someone to sponsor these items, but no, for five years nothing happened.

I would be absolutely wrong to say that Baru never gave anything to the people of Ba Kelalan.  He did some good.

1Malaysia poly water tanks supplied by 1M4U in Ba Kelalan
1Malaysia poly water tanks supplied by 1M4U in Ba Kelalan

The above are water tanks supplied by the 1M4U project, an initiative founded by the Prime Minister in 2012.  Villagers said that Baru claimed to them that it was through his initiative that the villagers had received these poly tanks.  You won’t see these poly tanks at every house that is in need, however. They were given only to supporters and houses of single-mothers, earning him the nickname “ADUN Janda” (The Assemblyman for divorced women).

Early this year Baru presented several houses with solar power units that could generate enough power to light two bulbs all night long, or charge up to two mobile telephones simultaneously during the day.  This time he made it clear that the gift was from a corporate sponsor.

So what else can be read on Baru Bian’s report card?

To say that the Barisan Nasional has done little to develop Ba Kelalan in the 48 years preceding his tenure is in a way naive bordering reckless of Baru.  While it may be true that Ba Kelalan did not get much under the previous Chief Minister’s administration, Ba Kelalan fared relatively well under Barisan Nasional. Going by my layman timeline, the Malaysian Communications and Multimedia Commission’s Universal Services Provision fund helped bridge the digital divide in rural Sarawak in among others Bario and Ba Kelalan.  With the introduction of the Internet and telephony to Ba Kelalan, tourism in Ba Kelalan prospered. Between January to May of 2014, Ba Kelalan’s homestays hosted 2,962 visitors earning close to RM656,000.  The Ba Kelalan villages of Long Langai, Long Lemutut, Long Ritan, Long Rusu, Buduk Bui, Buduk Aru now has 24-hour electricity supply thank you to the government’s initiative to install micro-hydro systems there.  The airport at Buduk Nur was built when Barisan Nasional was representing Ba Kelalan. The Long Luping to Ba Kelalan road was built with the assistance from the Ministry of Defence in 2010.  That road is now in bad condition because among others hardly any maintenance is done there. What, in the last five years, has Baru Bian done to make sure the road is in good working condition?

That is five years versus Adenan Satem’s two years in office. Baru should not compare Adenan Satem with his predecessor. If I want to be petty and make comparisons, Adenan has given Buduk Nur two PA systems. What has Baru given Ba Kelalan himself?  And Adenan, who hails from the Sarawakian political party called Parti Pesaka Bumiputera Bersatu (PBB)  has the support of Najib Razak who is from the Peninsular’s UMNO, the only Prime Minister to have made an average of eight trips to Sarawak per year since assuming office, and given billions of Ringgit back to the people of Sarawak to improve their livelihood.  Both are from different parties within the Barisan Nasional coalition.

In contrast, Baru who is from Parti Keadilan Rakyat (PKR) which is a Peninsular political party, cannot even get the backing of his leadership in the Peninsular to get the Democratic Action Party (DAP), a chauvinist political party that is the de facto party in command of the Pakatan Harapan (PH), also from the Peninsular, to ask DAP to refrain from contesting in five seats that PKR is contesting in the upcoming Sarawak State Elections. I doubt if Baru could call the shots in Sarawak even without being subjugated and undermined by those in the DAP.

Baru Bian may be Barisan Nasional’s candidate Willie Liau’s uncle.  But Baru Bian was born and grew up in Long Semadoh, a village 40km away from Ba Kelalan. Baru lives in Kuching, 1,200km away where he has his law practice and spends most of his time making name for himself taking on giant oil palm corporations such as IOI disguised as protecting native rights.

While Baru Bian should just remain an activist, Willie Liau who is also a lawyer is the right person for Ba Kelalan and he knows that only someone who is with the government can drive things through.  Unlike Baru, Willie is from Ba Kelalan’s village of Buduk Bui, like another famous Sarawak Progressive Democratic Party (SPDP) name – Datuk Nelson Balang Rining. Unlike Baru, Willie lives in the district capital of Lawas, a 125km road trip away. As mentioned by Tua Kampung Yudan Meru of Long Muda to BERNAMA recently, “Baru is a good man, but he is standing on the wrong platform. He is our brother but if he wins, it will be the same story… the people will suffer – until when? Willie is strong. I hope he wins big in Ba’Kelalan.

Lim Kit Siang is confident DAP will lose seven seats in Sarawak
Lim Kit Siang is confident DAP will lose seven seats in Sarawak

If you look at the faces above, even DAP’s Emperor Lim Kit Siang, the only dinosaur still alive since 1969, has that grim look on his face. He is confident DAP will lose seven of 12 seats held by DAP in Sarawak.  Claiming that Adenan Satem is throwing money around and promising development, which is what the people of Sarawak actually want, DAP has thrown in a challenge:

DAP's development promise to Sarawak
DAP’s development promise to Sarawak

If you look at the above photo, the red steel bridge costing RM60,000 will soon end up as a bridge to nowhere. Firstly, it does lead to nowhere as the land across the Batang Undup river is empty.  Secondly, if you look at the erosion of the riverbank and the curvature of the river, you know that that bridge will sooner or later lead to nowhere as the banks will continue to get eroded by the river flow.  Without sheet pile protecting the soil, soon the end of the river would be good as a fishing platform. If there is no anti-rust coating beneath that red paint, it would go much sooner than a wooden bridge or a steel bridge treated with anti-rust.

If the above are the ones who will be calling the shots, Baru Bian is better off as an activist on his own, working with non-governmental organisations, or work hand-in-hand with the state government for the betterment of the indigenous people of Sarawak if he is truly sincere.

As the Lun Bawangs would say, “Aleg ninger buek tang arang gawa’!” (Don’t listen to voices from the sky). Put both feet firmly on terra firma and do good for your people for once.  Don’t give them honeyed words like those who have evil mind wanting to subjugate you.
