Constitutionally Speaking

The Opposition (DAP, BERSIH, Pribumi) is just recycling old issues. No matter if the issue raised had been clarified or debunked countless times before. I did not include PAN in the parentheses because it would be ridiculous in my opinion to even consider it a political party given the cartoon characters that fills its ranks. Not even BERSIH’s convoy in Penang could garner more than 50 supporters to join its convoy in that staunch Opposition state! A sign of times, perhaps? Issues like 1MDB is being played over and over again, especially by Mahathir’s Das Schwarze Korps but hardly gained any traction as people are bored of the same story being played repeatedly with goalposts changed to suit the message they try to send.

So, what should they do next?

Enter His Majesty Yang DiPertuan Agong.

Before the independence of Malaya in August 1957, there were three parties to the discussion on the subject of the independence. They were the Malay Rulers of the Federated and Unfederated Malay States; the British who, by virtue of treaties signed with the Malay Rulers, helped administer their respective state; and the Alliance party (UMNO, MCA and MIC) who, by virtue of winning all but one seat in the 1955 General Elections was the de facto voice of the people of Malaya. Save for Pulau Pinang and Melaka, the rest of the states in Malaya were NOT colonies of Great Britain. Therefore, the discussion was about the transfer of administrative powers from the representatives of the Malay Rulers (the British) to a government formed through the elections by the people of Malaya. 31st August 1957 was an independence from feudalism, not colonialism. You must understand that while the Rulers retain some of their functions, the government is run by those elected by the rakyat. This was done to ensure that democracy in then-Malaya was not to do away with the Malay Rulers. Therefore, Mahathir’s attempt to get the Rulers Institution to dismiss Najib Razak for someone else as the Prime Minister, there is nothing that any of the Rulers could democratically do. The Rulers, although above the law, are not above the Federal Constitution. Like with the British advisors, there is virtually nothing that the Rulers could do without the advise of the Prime Minister or the Menteris Besar to affect the state or Federal administration except in a few circumstances.

Article 43(2) of the Federal Constitution states that:

2) The Cabinet shall be appointed as follows, that is to say:

(a) The Yang di-Pertuan Agong shall first appoint as Perdana Menteri (Prime Minister) to preside over the Cabinet a member of the House of Representatives who in his judgment is likely to command the confidence of the majority of the members of that House; and

(b) He shall on the advice of the Prime Minister appoint other Menteri (Ministers) from among the members of either House of Parliament

What it says here is in order to have a functioning government, the Yang DiPertuan Agong would have to first appoint a Prime Minister who in his judgment is likely to command the confidence of the majority of the Dewan Rakyat members. The term ‘who in his judgment is likely to command the confidence of the majority of the members of that House‘ here is critically important and we shall visit this aspect later. This term and Article must be read together with Article 40(2) of the Federal Constitution that says:

The Yang di-Pertuan Agong may act in his discretion in the performance of the following functions, that is to say:

(a) the appointment of a Prime Minister;

(b) the withholding of consent to a request for the dissolution of Parliament;

What it means according to Article 40(2) of the Federal Constitution is that the Yang DiPertuan Agong has the discretionary power to appoint the Prime Minister subject to his own discretion but limited to the ambit of Article 43(2) of the same. In Article 43(5) states that only Ministers can be dismissed by the Yang DiPertuan Agong on the advice of the Prime Minister:

Subject to Clause (4), Ministers other than the Prime Minister shall hold office during the pleasure of the Yang di-Pertuan Agong, unless the appointment of any Minister shall have been revoked by the Yang di-Pertuan Agong on the advice of the Prime Minister but any Minister may resign his office.

In Teh Chang Poh vs PP (1979 – 1 MLJ 50) William John Kenneth Diplock (Lord Diplock) opined the following:

Although this, like other powers under the Constitution, is conferred nominally upon the Yang di-Pertuan Agong by virtue of his office as the Supreme Head of the Federation and is expressed to be exercisable if he is satisfied of a particular matter, his functions are those of a constitutional monarch and except on matters that do not concern the instant appeal, he does not exercise any of his functions under the Constitution on his own initiative but is required by Article 40(1) to act in accordance with the advice of the Cabinet. So when one finds in the Constitution itself or in a Federal law powers conferred upon the Yang di-Pertuan Agong that are expressed to be exercisable if he is of opinion or is satisfied that a particular state of affair exists or that particular action is necessary, the reference to his opinion or satisfaction is in reality a reference to the collective opinion or satisfaction of the members of the Cabinet, or the opinion or satisfaction of a particular Minister to whom the Cabinet have delegated their authority to give advice upon the matter in question.

Therefore, Constitutionally-speaking, the Prime Minister can only be replaced in only two circumstances:

when the Prime Minister loses the majority of support of the members of the Dewan Rakyat (therefore the appointment of a new one would have to be based on the judgment of His Majesty the Yang DiPertuan Agong that has the most majority support of the Dewan, or,
A General Election causes the Prime Minister to lose his parliamentary seat, and His Majesty would have to appoint one before appointing a Cabinet as prescribed in Article 43(2)(a).

The Yang DiPertuan Agong therefore cannot act ultra vires.

So, why is Mahathir’s Schwarze Korps so eager in pushing the idea of the Rulers Institution being able to remove a Prime Minister?

The answer is: propaganda that only zombies would accept at face value.

Just like the 1MDB issue where Schwarze Dummkopf A Kadir Jasin et al are saying that the investigation into the case has stopped altogether, whereas the Inspector-General of Police had announced on 19 August 2016 that the investigation into the 1MDB issue has entered its second phase!

I guess Mahathir’s interest in ousting Najib Razak is just so one of his Pribumis could be appointed as the Prime Minister. For that reason he is trying to make a pact with Anwar Ibrahim’s PKR. He knows that his lie about the powers of the Agong to remove Najib Razak will soon be debunked, and that it is just noise – no substance. Therefore, he would need to work with PKR, DAP and jumpers from the BN to oust Najib Razak in accordance with Article 43(2)(a).

However, despite declaring that Muhyiddin would become the Prime Minister if the Opposition wins, we all know that the protem President of Parti Pribumi would never make it as the Prime Minister. Muhyiddin has far too many baggages that would be easy to pick on. His son Mukhriz is the favourite contender. He said so HERE.

The above was taken from Mahathir’s latest blog posting entitled ‘Propaganda.’ In this posting he likens Najib Razak to being a Nazi with pro-Najib bloggers such as BigDog and Rocky Bru, former staunch supporters of his, as being the Little Goebbels for Najib Razak. Whatever label that you wish to put on BigDog, I know for one thing his loyalty, other than to the nation, is to the Malays and the Malay cause. Like me, the straw that broke the ‘sympathy-for-Mahathir‘ camel’s back was when Mahathir joined the BERSIH protest last year, licking his own gob as he backtracked on his own words to not work with the opposition and condemn street demonstrations.

Attacking the bloggers,if the defence of Najib Razak or attacks on behalf of him is not working, is not wise at all. It goes to show that the likes of BigDog and Rocky are in fact making an impact on Mahathir’s struggle to oust the Premier. Likening Najib Razak to a Nazi while he is in Germany is not prudent at all. It shows how insensitive Mahathir is and a lack of decorum on his part. Then again, when has Mahathir ever showed to possess any sense of decorum at all, if any?

However, history has proven that there is someone with a racist and anti-semitic traits amongst us. Mahathir Mohamed is his name. So many things that he had said even before his premiership that points to these traits. Then again, what is Mahathir without his acid tongue?

First and foremost according to this blog, Mahathir s/o Iskandar Kutty is ashamed of his heritage. In fact, Philip Bowring who was an Editor for the Far Eastern Economic Review and a South China Morning Post columnist once wrote:

‘In his new book, A New Deal for Asia, he writes about his father in such a way as to imply that he was a Malay dedicated to the improvement of his fellow Malays rather than the hard-working Indian immigrant and government servant that he was. No mention of Dr Mahathir’s Indian Muslim background ever appears in the media. The subject is taboo.’

And UMNO suffered for 22 years being the cover for Mahathir to hide his true identity while creating a Herrenvolk culture to underscore his superiority especially over the Indians. In fact, he is now surrounded by people like him who could be termed as Ehrenarier, who are neither Malay but nor would they admit to who they really are. In 1922, Hitler said in a conversation with Major Joseph Hell (Josef Hell, “Aufzeichnung,” 1922, ZS 640, p. 5, Institut für Zeitgeschichte) that when he has power, “the destruction of the Jews will be my first and most important job. As soon as I have power, I shall have gallows after gallows erected, for example, in Munich on the Marienplatz-as many of them as traffic allows. Then the Jews will be hanged one after another, and they will stay hanging until they stink.”

Mahathir said something similar in 1979 about the Vietnamese boat people that was quoted by the Associated Press saying Malaysia would expel 75,540 boat people as well as “arm itself with legal powers to shoot new arrivals on sight.”

In October 2003, just before he left office, he made an anti-semitic remark in October 2003 that got played up by the Western media. Malaysia is labeled anti-Semitic until today, no thank you to Mahathir. While we are anti-Zionism, I doubt Malaysia is anti-Jew. One of my former bosses is a Jew who even contributed to a mosque for iftar during Ramadhan.

That is Mahathir being brash and abrasive for you…just so he could get somewhere.

I won’t write about how anti-Chinese Mahathir is. He enriches a few Chinese businessmen so they would be indebted to him, but at the same time help him to keep the mass of Chinese crabs in a barrel firmly inside the barrel. You can read more in his ultra-Malay book:

I read that when I found it in my father’s study room back in 1976. It made me worry when Mahathir replaced Hussein Onn as the Prime Minister in 1981. Since then, the DAP Chinese have been using the excuse of being victimised by the Malays, in particular by UMNO. Today, whenever the DAP creates racial tension and the Malays react, they would cry victimisation.

Who are we to blame? Erasing two decades of damage done to Malaysia by Mahathir is not easy. The interracial resentment has set in deep and the outcome of the General Elections of 2008 was the direct result of that. The fact that his followers are still worshipping him for his past while turning a blind eye to his present role as a one-man demolition derby does not help either. He had probably read ‘Mein Kampf‘ before writing ‘Malay Dilemma‘. Therefore, it comes as no surprise that the Supreme Leader of Parti Pribumi was once referred to as HITLER.

Perhaps, we need a proper Entnazifizierung program for them. But until then, Mahathir will just stand proudly while watching his band of Schutzstaffel march past him to do his bidding.

Prime Minister Najib Razak’s 3-day visit to Germany has been a success. Starting with a dialogue session with German Business Leaders made up of 24 German renowned companies and four Malaysian companies that have invested in Germany, together with various trade and industrial associations that have operations and investments in Malaysia. This dialogue session focused on the manufacturing sector as Germany is a renowned high-technology industrial nation that is highly innovative especially in the automotive, machineries, electrical and the electronics sectors.

The objective of this dialogue session was not only to inform the German business community about the two-way trade and investments between the two nations, but also to obtain feedbacks and views from German investors. With Germany being the largest trading partner from the European Union, with investments in the manufacturing sector reaching USD11.4 billion, it is apt for Malaysia to propose itself to become the host for the 16th German Asia-Pacific Business Conference. The last time Malaysia played host to this conference was in 2000.

Najib Razak also witnessed and attended MoU signing ceremonies and trade discussions with companies that are involved in the pipeline, semiconductor, aviation, automotive as well as the shipping industries with one company committing to a second wave of investment to set up three competence centers.

The Prime Minister also held a bilateral meeting with Chancellor Angela Merkel discussing international terrorism, the refugee situation as well as the South China Sea disputes.

In another development, Najib Razak says that Malaysia wants to see those involved in the crime of the downing of Flight MH17 to be brought to justice, and would like to see nations involved to hold a discussion to identify the ways forward to fulfill promises made to the victims’ next-of-kin.

It is unfortunate that Mahathir thinks that Malaysia has slid into the abyss of failed states when she continues to enjoy the confidence of foreign businesses and investors and continue to prosper under the stewardship of Najib Razak.

When Will Kit Siang Ask Mahathir About “Project IC”?

Having found a partner-in-crime in Mahathir, Lim Kit Siang pushes aside all allegations that he had made against the founder of the Pribumi party.

Three years on, as the DAP Parliamentary Leader still owes the people of Sabah an answer pertaining to Mahathir’s involvement in the IC-for-vote scam otherwise known as “Project IC” or “Project M.”

I am not making this up. I am merely asking Lim Kit Siang if, now that he has Mahathir’s ears, the allegations he had made against the latter are true, or if he had been misleading the Sabahans especially in a scam of his called “I-Lie-For-Votes”?

Katanya, Mahathir juga sepatutnya menjawab kepada rakyat Sabah dan Malaysia mengapa beliau hidup di dalam pembohongan selama dua dekad iaitu 10 tahun sebagai PM dan 10 tahun selepas bersara apabila menafikan kewujudan Projek IC atau Projek M yang melakukan penipuan “kewarganegaraan-untuk-undi”.
“Persoalannya, bagaimana rakyat Malaysia mahu melihat dasar 1Malaysia Najib sebagai sebuah dasar yang serius bagi menjadikan Malaysia yang lebih berdaya maju, lebih produktif dan lebih berdaya saing apabila usaha pembangunan bangsa bukan saja oleh Tunku Abdul Rahman, juga satu juta warga generasi Merdeka diperkecil malah difitnah seperti yang dilakukan Mahathir.
“Mahathir mendakwa Tunku melakukan sesuatu yang lebih teruk daripada Projek IC atau Projek M apabila memberi kewarganegaraan kepada sejuta warga semenanjung Malaysia yang tidak layak,” katanya dalam kenyataan media mengenai Pengiraan Detik 82 hari ke PRU-13, semalam.

Kit Siang yang juga Ahli Parlimen Ipoh Timur berkata, matlamat 1Malaysia adalah untuk menjadikan Malaysia lebih berdaya maju, lebih produktif dan lebih berdaya saing, dan kemuncaknya sebuah negara yang hebat: sebuah negara yang diharapkan agar setiap warga Malaysia melihat dirinya terlebih dahulu sebagai rakyat Malaysia, dan kemudian barulah melihat dirinya berdasarkan bangsa, agama kawasan geografi dan latar belakang sosial, dan juga sebuah negara yang diharapkan agar prinsip 1Malaysia dijalin dalam struktur ekonomi, politik dan sosial masyarakat.

Menurutnya, Rakyat Malaysia sekarang bingung dengan jawapan Najib selepas mesyuarat Majlis Tertinggi Barisan Nasional Khamis lalu mengenai pendedahan penipuan “kewarganegaraan-untuk-undi” oleh Suruhanjaya Siasatan Diraja (RCI) mengenai pendatang tanpa izin di Sabah dan reaksi Mahathir.

“Sebenarnya, Najib tidak katakan apa yang lebih penting daripada yang beliau katakan iaitu masih awal untuk membuat kesimpulan daripada RCI memandangkan ia masih di peringkat permulaan dengan 167 lagi saksi akan dipanggil, Najib juga berhati-hati mengelak memberi komen kepada fitnah Mahathir terhadap Tunku serta satu juta warga generasi Merdeka.

“Adakah ini bermakna Najib menyokong fitnah Mahathir bahawa Tunku memberi kewarganegaraan kepada sejuta warga tidak layak iaitu bukan saja mengaitkan Bapa Malaysia tetapi juga bapa Najib, Tun Razak
“Saya harap Najib segera membersihkan bukan saja nama Tunku tetapi juga bapanya, Tun Razak dan menjauhkan dirinya daripada fitnah Mahathir itu,” katanya.

The Road To Malaysia: Part 1 – The Malaysia Concept

“Najib Abdul Razak has done more for Sarawak than all the previous Prime Ministers, including the one who served for 22 years,” said Sarawak Chief Minister, Adenan Satem to a crowd of about 3,000 people at the State Gawai Dayak Dinner in 2015 (Malaysiakini: 4 June 2015). That was what crossed my mind when thinking about sacrifices on the morning of the first day of Aidil Adha. Najib Razak broke previous Prime Ministers’ record for being the PM who has visited Sarawak the most and has brought about promising developments in both Sabah and Sarawak including the toll-free Pan Borneo Highway. What is most important is the capacity building for Bumiputera contractors through the 30 percent participation of Bumiputera contractors in this project.

All this had its beginnings more than 50 years ago when both Sabah and Sarawak were the British Colonies of North Borneo and Sarawak.

Prior to 1948, there was no country called Malaya but a territory of nine sultanates as British Protectorates and three Straits Settlements as Crown Colonies. Only the Crown Colonies were under direct British rule via the Colonial Office (Seademon Says: The Road to Merdeka – British Malaya, 12th September 2011). The British almost succeeded in implementing a Federation albeit through the shortlived Malayan Union, but that was later replaced with the Federation of Malaya on 1st February 1948.

Back then, Malaya was just a place for the Chinese migrants to work for money that would be sent home to China – the country the British had encouraged them to remember as their home during the interwar years. Tun Ghazali Shafie, then the Deputy Assistant District Officer of Kuala Lipis. He recalled how, when asked if the Chinese would support the Malays in an endeavour to dislodge all British Advisors from all the states of Malaya, the Justice of Peace for Kuala Lipis Mr Ong Siong Teck replied, “We Chinese had always been independent. Of course, but we must be given a place.”

On the 27th July 1955, the Alliance Party had won all but one seat in the Federal Legislative Council elections, and on Sunday, 31st July 1955, the Tunku handed the British High Commissioner his list of cabinet members (six Malays, three Chinese and two Indians) that would still have to be passed to the Rulers for their formal concurrence. This was when the Federation of Malaya gained self rule, a big step towards independence. At this time, there was a planned hegemony over the mainland including Malaya and Singapore, leaving the islands to Sukarno’s Indonesia (Seademon Says: The Road to Merdeka – Persekutuan Tanah China, 6th September 2011). Communism was rearing its ugly head at Malaya, Singapore and Borneo.

By June 1959, Singapore had its General Elections and Lee Kwan Yew’s People’s Action Party (PAP) was swept into power. The communist group in Singapore, including those in the PAP, had to lie low for the time being as Kuan Yew had promised the British that he would not allow any subversive elements to conduct their activities. Singapore was keen for a merger with Malaya as that would grant them independence and assure them that the Federal government of Malaya would never allow the communists to exist.

By the end of April 1961, the situation in the South East Asia had changed drastically with the Pathet Lao guerrillas had come quite close to Luang Prabang in northern Laos, with the help of the Soviet Union and China. It was then that Ghazali Shafie pressed the Tunku to hasten the “Malaysia Concept” to create a Federation of Malaya, Singapore and the British North Borneo that included the Sultanate of Brunei.

On the 27th May 1961, the Tunku signalled the birth of the “Malaysia Concept” in a speech in Singapore to the Foreign Correspondents Association (Ghazali Shafie’s Memoir on the Formation of Malaysia, 1998 pg.26):

“…sooner or later Malaya should have an understanding Ong Siong Teck Britain and the peoples of Singapore, North Borneo, Brunei and Sarawak. It is premature for me to say now how this closer understanding can be brought about, but it is inevitable that we should look ahead to this objective and think of a plan whereby these territories can be brought closer together in political and economic cooperation…”

“In North Borneo, there were already signs that Manila was going to make a cartographic claim based on some vague historical background,” wrote Ghazali Shafie, “(and) the Communist Clandestine Organisation (CCO) in Sarawak with assistance from abroad had begun to show its fangs and claws. Whitehall would never do nything very positive for the people and that colonial territory could not be defended by armed means in the post-World War II period of anti-colonialism.”

The British then planned for a federation for North Borneo, Brunei and Sarawak, and some British officials in Brunei even encouraged the locals to hate Malayan expatriates there. In fact, a Malayan forest officer, Yakin, was assaulted by Bruneians. These Malayans were there at the request of Sultan Sir Omar Ali Saifuddin III to replace British officials in key posts, making the Bruneians think that the Malayans were stealing their jobs and subtly colonising them.

The Yang DiPertuan Agong, the Tunku and Malaysian officials visiting Brunei were subjected to insults and had the word CONGO shouted at them. The truth is no Brunei high officials had ever bothered explaining to the people of Brunei the reason they were there, including Haji Marsal Maun, the Menteri Besar of Brunei.

Before ending the visit, the Tunku made a radio broadcast to the people of Brunei telling them that the presence of Malayan officials in Brunei was at the request of His Highness the Sultan of Brunei and it was never Malaya’s intention to colonise.

While the Yang DiPertuan Agong left Brunei for Kuala Lumpur, the Tunku continued his tour to Sibu on board the KD Mutiara. She was the first ship that was specifically built for the Royal Malayan Navy. She was also the first RMN vessel to be given the “Kapal DiRaja” title and was the first RMN vessel to be built locally. Their destination was Sarawak, a state that was once a realm of Brunei until 1841 when James Brooke was granted the areas around Kuching and Bau, from Sultan Omar Ali Saifuddin II, and was later given the title Rajah of the territories. The White Rajahs ruled Sarawak until 1946 when after the war Charles Vyner Brooke, the 4th Rajah of Sarawak ceded his interest in Sarawak to the Colonial Office for a sizeable pension for him and his three daughters. Unsure of the legality of the cession, the British Government quickly passed a Bill of Annexation, effectively ending the rule by the White Rajahs.

In Sibu the Tunku met with Temenggung Jugah, Aini Dobi (whose brother Rosly Dobi was hanged for the assassination of Governor Duncan George Stewart in 1949), Tuanku Bujang, Abang Louis Barieng and Ahmad Zaidi Adruce. An Iban in the administrative service in Sibu approached Ghazali Shafie asking the latter to explain more about the “Malaysia Concept.” Ghazali Shafie told the former in general what it was all about and the intentions of uplifting the indigenous people using the same special position of the Malays in the Malayan Federal Constitution. Bennet agreed that Sarawak could achieve independence through the “Malaysia Concept” but his worry was having the Chinese from Singapore flooding Sarawak. Ghazali suggested that Sarawak could ask for special powers to control immigration to which Bennet touched Ghazali’s hand saying, “Please help us.”

The Ibans were in a dire strait. Sibu was a town that was very Chinese – 95 percent of its 29,630 inhabitants in 1961 were Chinese. In comparison, Sibu had 162,676 inhabitants in 2010 and 65 percent were Chinese. A school that the Tunku had visited just outside of Sibu only had a Primary Two class and was not able to find a teacher compared to a Chinese school nearby. The British were not interested in developing the locals and if the situation was to continue for long, the rate of development for the Iban would be slow compared to the Chinese who had very good schools. Even Temenggung Jugah was illiterate. He had a signatured tattoed to his left arm and would put his left arm on a piece of paper so he could copy that to sign documents!

As they left Sibu and the KD Mutiara sailed down the Rajang, it was obvious that Sarawak as a colony would not be left alone by Communist China. Ships from China sailing the Rajang had revolutionary songs blaring over their tannoy system, even in the town of Binatang (now Bintangor). It was obvious that the Chinese were using revolutionary propaganda to stir up anti-colonial feelings amongst Sarawak’s masses, and that the “Malaysia Concept” would be the best way to save Sarawak especially from China.

When the KD Mutiara sailed past Binatang, a town of a few brick houses and a dirt road, the people had come out to the jetty shouting for the Tunku to stop. The Tunku requested for Lt Ismail, the CO of KD Mutiara to anchor so he could go ashore. The Tunku was met by hundreds of people who gave him a very warm welcome, and the Tunku gave them some words of encouragement. Ghazali was met by two young people, an Iban police inspector and a Malay customs officer. Ghazali noted that both were critical of the colonial administration which had never brought any development to the local people. These two officers later resigned from their respective jobs and spent full time promoting the “Malaysia Concept.”

Sarawak Repost

Give enough rope and he will hang himself

That is how the idiom goes. Muhyiddin was the first one to admit that there was a conspiracy to topple Najib Razak. Then recently Mahathir himself named the conspirators as former Governor of Bank Negara Zeti Aktar Aziz, former Attorney-General Gani Patail, and former head of the Malaysian Anti-Corruption Commission Abu Kassim. Mahathir’s favourite news portal Sarawak Report has now joined in and underscored the role of the three in trying to bring down Najib Razak. This time around, the Sarawak Report (SR) has gone overboard by including His Majesty The Yang DiPertuan Agong into the conspiracy.

The SR claims that by middle of 2015, all three conspirators agreed that Najib Razak had embezzled billions from public funds “not only to fund lavish frivolities for the PM and his wife and family, but also influence the outcome of a very tight election.”

First and foremost, the investigation into the 1MDB was far from over in the middle of 2015. A quick check of SPRM’s press statements archive found no such announcement being made. Furthermore, Najib Razak as the accused had not been called to give his statement regarding the 1MDB, and it was only in December 2015 that Najib Razak was summoned to do so. How a charge sheet was drafted before investigation was completed is beyond me. When investigations were completed and submitted to the 20-member Public Accounts Committee, the PAC released its findings on 7th April 2016 that there is absolutely no truth in billions having gone missing, and that the 1MDB issue is solely governance in nature. This findings was also agreed and signed by six Opposition members of the PAC including Tony Pua himself.

As for influencing a very tight election, the SR’s myopic reporting means that nothing is ever mentioned about journalist Nile Bowie’s report on the millions of USD channeled to the Opposition and/or Opposition-friendly organisations annually to fund activities that would destabilise the ruling government.The National Endowment for Democracy (NED) has channeled millions to beneficiaries such as SUARAM, BERSIH, Merdeka Center for Opinion Research through the National Democratic Institute for International Affairs (NDI) and the International Republican Institute (IRI). The IRI, said Nile Bowie, received $802,122 in 2010 to work with “state leaders in Penang and Selangor to provide them with public opinion research, training and other resources to enable them to be more effective representatives of their constituents”. IRI claims that it “does not provide direct funding to political parties” in Malaysia, but their lack of transparency, significant budget and emphasis on helping broaden the appeal of political parties in opposition-held states suggests at the very minimum that funding is taking place indirectly.

The SR also claims that Najib Razak is the sole shareholder and decision-maker in the 1MDB and the only man able to sign off investment decisions such as the Joint Ventures with Petrosaudi and Aabar,

Perhaps, the SR does not know that the Minister of Finance (Incorporated) was passed in an Act of law in 1957 through the Minister of Finance (Incorporation) Act, 1957 that was revised under Mahathir Mohamad’s tenure in September 1987. Its objectives are to ensure sustained and continuous economic growth; to strengthen national competitiveness and economic resilience; to ensure effective and prudent financial management; to pursue a more equitable sharing of national wealth; and to improve quality of life and well being of society. It is headed by one Encik Asri of Bahagian Menteri Kewangan (Diperbadankan). And mind you, Najib Razak is not the only Minister of Finance. There is a dedicated Minister of Finance whose time is 100 percent there unlike Najib Razak. He is NOT a Deputy Minister, he is a FULL Finance Minister.

Of course, according to the SR, the conspirators then had no choice but to bring the matters to His Majesty Yang DiPertuan Agong, and the Yang DiPertuan Agong agreed that Najib Razak should step down “while prosecution took its course.” Like I mentioned above, how was it possible for prosecution to proceed when Najib Razak himself had not been questioned on his involvement by the very agencies claimed by SR to have decided to prosecute? Furthermore, what Constitutional powers does the Yang DiPertuan Agong have to tell Najib Razak to step down? Even Lim Guan Eng, already investigated and charged in court on two counts of corruption, has not left office to let prosecution take its course!

On the 28th July 2015, Gani Patail was removed as the Attorney-General and was replaced by Mohamed Apandi Ali. SR pointed that the act of removing the AG was unconstitutional. Allow me to go slightly deep into the Federal Constitution of Malaysia to comment on this claim.

The Federation of Malaya was born on 31st August 1957, adopting a new Constitution that replaced the Federated Malay States Constitution of 1948. During that time, the Attorney-General was Cecil Majella Sheridan, a practicing solicitor who joined the Colonial Legal Service to help reopen the courts in 1946 after World War Two. He was posted to Kelantan and Terengganu to become the States’ Legal Adviser and Deputy Public Prosecutor. In 1955, he became the Legal Draftsman for the Federation. Upon Indepence, Sheridan was made the Solicitor-General and subsequently the Attorney-General in 1959. Sheridan then began to prepare for the enlargement of Malaya into Malaysia (with the accession in 1963 of Singapore, Sabah and Sarawak). In the process, he worked closely with Tunku Abdul Rahman, Tun Razak, and Lee Kuan Yew, of Singapore.

During this time, Article 145 of the Federal Constitution was limited to five clauses only. Article 145(5) then provided that “the Attorney-General shall not be removed from office except on the like grounds and in the like manner as a judge of the Federal Court.” This Article was drafted by the Reid Commission and subsequently passed to be included in the Federal Constitution of 1957. A Government White Paper explained the need for Article 145(5):

“It is essential that , in discharging his duties, the Attorney-General should act in an impartial and quasi-judicial spirit. A clause has therefore been included to safeguard the Attorney-General’s position by providing that he shall not be removed from office except on the like grounds and in the like manner as a Judge of the Supreme Court.”

This is still maintained in Articles 105(3) for the Auditor-General and 125(3) for the Judges.

With the imminent formtion of the Federation of Malaysia, Sheridan amended Clause 5 of Article 145 and added Clause 6 to facilitate his eventual removal from the AG’s position. Article 145(6) of the Federation of Malaysia Constitution, 1963 reads:

“The person holding the office of the Attorney-General immediately prior to the coming into operation of this Article (note: specific reference to Sheridan) shall continue to hold the office on terms and conditions not less favourable than those applicable to him immediately before such coming into operation and shall not be removed from office except on the like grounds and the like manner as a judge of the Federal Court.”

And Clause 5 of the Article was changed to the following:

“Subject to Clause (6), the Attorney-General shall hold office during the pleasure of the Yang DiPertuan Agong and may at any time resign his office and, unless he is a member of the Cabinet, shall receive such remuneration as the Yang DiPertuan Agong may determine.”

Article 145 was amended for two reasons according to Sheridan’s successor, Abdul Cadir Yusoff: one is the desire to have “the most suitable person available for the performance of the onerous tasks” of the AG’s office regardless whether the person was from the pubic service or not, and secondly the impartiality of a political appointee could be assured by conferring on him “untrammelled constitutional discretion.” Bear in mind that Abdul Cadir was both a lawyer and a politician and could not have been appointed under the previous version of the Constitution. Nowhere in the Constitution, in its present form, requires for the formation of a tribunal to remove or replace an Attorney-General as applicable to the Auditor-General and Judges via Articles 105(3) and 125(3).

Therefore, Gani Patail’s removal was not unconstitutional.

I refuse to comment on the rest of the fairy tale that Clare Rewcastle Brown had conjured because she seemed excited plucking these stories from a very low sky that her nipples probably scrape the ground giving her that pleasure. Like the story about the fire that had occured at the Royal Malaysian Police Headquarters in Bukit Aman, as she claimed “destroyed evidence of money laundering” when the division that was investigating the 1MDB issue is housed in a different building in a different part of the Bukit Aman complex. Also on the murder of DPP Kevin Morais whom she said was the one who had drafted the charge against Najib Razak when the poor sod was confirmed by his own brother and by authorities not investigating 1MDB.

You can choose to believe Sarawak Report if you wish to. All Clare Rewcastle Brown does is to repost trash and expands on it, grabbing more invisible low hanging fruits while her nipples harden at being scraped against the asphalt. Must make her wet teling lies. But it’s funny how the white trash seem to have conveniently omitted Justo from the equation.

Nothing to hide? I don’t think so.

Former Sabah Chief Minister Tan Sri Joseph Pairin Kitingan knows very well what Mahathir would do to those he hates. He experienced that first hand in 1990 when Mahathir went all out to try depose him as Chief Minister. Pairin was Chief Minister of Sabah from 1984 to 1995.

Speaking to reporters after receiving a courtesy visit from the Kadazandusun Cultural Association Youth Council yesterday Pairin said that when Mahathir is a ‘political animal’ who, when he does not like a person, would go all out (to get the person out of his way).

Therefore, it comes as no surprise to Pairin when Mahathir would form a new party and work with his enemies just to try force Najib Razak out of office.

In politics, anything goes – wrote Awang Selamat, a pseudonym used for Utusan Malaysia’s editorials. And that includes trying to erase his dark past by working with DAP’s Lim Kit Siang whom he had put behind bars without trial during his tenure. It was Mahathir whom had planted the idea that DAP is nothing less than the enemies of the Malays and what Malaysia stands for, in the mind of the Malay masses. Equally disgusting is Lim Kit Siang whom had spent most of his life in DAP slandering Mahathir as being the most corrupted dictator, now seen being in the same bed with Mahathir.

Another person who would know Mahathir well is Tan Sri Musa Hitam, who was Mahathir’s deputy from 1981 to 1986. While he described Mahathir as “observant, innovative, and meticulous” he also used the words “authoritarian, contemptuous, and belligerent”.

In an article by The Star, Musa said Dr Mahathir could be pleasant and engaging at times, but would often come off as being disinterested in dialogue or debate.

“Discussion and debate were never the order of the day,” he wrote in his book ‘Frankly Speaking’ which was recently launched by His Royal Highness the Sultan of Perak.

In his book Musa wrote:

“Malaysia today is going through a difficult transition. Trying to establish a mature democracy after more than two decades of authoritarian rule is not easy. Moreover, there is no guarantee that the current, more open political system will continue. Malaysia would, in fact, find itself gripped by reactionary forces that even now are advocating policies and practices that – if adopted – would eventually result in the country becoming a failed state.”

This was echoed by the former Grand Mufti of Jordan, Professor Dr Amin Mohammad Sallam al-Manasyeh in an interview with the portal MalaysiaGazette. “I am of the opinion that if Allah gives him (Najib) time, he will continue to develop and position Malaysia as the best country in the world. That’s what I think about him,” he said in the interview.

I, too, had doubts about Najib Razak’s ability to do well as the leader of this country. Up until April of 2015 at least, I and like-minded friends did not think that he would last in the face of relentless acrid attacks by Mahathir. By May, Mahathir faltered and changed goalposts several times while Najib Razak stood firm, unwilling to budge even a bit. Most of us saw that the light shone by Najib in the tunnel of lies made by his detractors is far brighter than the one shone by Mahathir. And this year, Mahathir received multiple slaps first in the form of the resignation of his son Mukhriz as the Menteri Besar after being told by the Council of Regent of Kedah that he had lost majority support of the State Assembly. This was followed by his own resignation from UMNO. Then came the hattrick wins in Sarawak, Sungai Besar and Kuala Kangsar elections where, despite Mahathir’s claims, Barisan Nasional still won. And then he was conned by his own people for faking more than half a million signatures of people reportedly in support of his ‘Save Malaysia’ declaration.

One would think that at 91, Mahathir would take it slow and call it a day. Well, that is not Mahathir. In the end he sets up another political party called Parti Pribumi Bersatu Malaysia (BERSATU) where Najib’s former deputy Muhyiddin Yassin becomes the pro-tem President, and his son Mukhriz the pro-tem Treasurer. And where is Mahathir in this party? He positions himself as Lim Kit Siang has – the Puppet Master. Despite being a political giant, Muhyiddin has all but lost support in Pagoh and Muar. Many Johoreans still remember him for his sins committed against the Malays. He would now have to find another seat to contest in. Otherwise his political career is as good as over.

Admitted to the National Heart Institute for medical complications the day his party’s registration form was submitted to the Registrar of Societies, Mahathir’s first act upon being ill was to post a blog article attacking Najib, not taking care of his health or coming to a realisation that his days as a mortal are numbered, and that instead of creating more sins, he should repent. No, things like that never seem important to Mahathir. And neither would the parasites who call themselves “his advisers” advise the old man to slow down. Instead, they feed his anger, and he in turn feeds them for making him angry. And Mahathir should remember that whenever he, the authoritarian, gets angry, he loses support. Zuraidah Ibrahim aptly puts it in the South China Morning Post:

Instead of departing on his terms, as he did in 2003, he may now find himself leaving the scene a loser.

For Najib Razak, it is business as usual. As in the old adage wrongly attributed to Thomas Jefferson:

In matters of style, swim with the current; in matters of principle, stand like a rock.

And like a rock does he stand.

Tabung Haji Terus Berjaya

Berita menggembirakan.

Semalam Perdana Menteri Dato Sri Najib Razak telah mengumumkan bahawa Tabung Haji telah berjaya mencapai objektifnya membantu rakyat Malaysia mengerjakan ibadah Haji pada kadar bayaran kos yang agak rendah.

Tambah beliau lagi, Tabung Haji telah berjaya mengekalkan kos mengerjakan Haji di paras RM9,980 dengan memberi subsidi sebanyak RM8,000 bagi setiap jemaah yang berdaftar dengan Tabung Haji. RM160 juta yang digunakan Tabung Haji untuk tujuan subsidi ini datangnya dari pelaburan aset dan hartanah oleh Tabung Haji termasuk pembelian tanah TRX yang dipolitikkan melalui fitnah agung pada tahun lepas oleh pihak-pihak yang tidak bertanggungjawab termasuk Mahathir Mohamad dan Rafizi Ramli.

Rafizi kini sedang dibicarakan kerana menggunakan dokumen rasmi untuk menyebarkan fitnah terhadap Lembaga Tabung Angkatan Tentera walaupun sebagai Ahli Parlimen beliau telah mengangkat sumpah untuk mempertahankan rahsia negara.

Akibat fitnah Rafizi terhadap Tabung Haji, seramai 7,054 orang telah mengeluarkan caruman mereka di Tabung Haji. Ini termasuk juga mereka yang telah membatalkan hasrat untuk menunaikan Haji.

Saya masih teringat kata-kata arwah datuk saya:

“Nak ke Mekah sendiri ni (untuk Umrah dan Haji) kena ada tiga perkara. Kesihatan, wang, dan dijemput Allah SWT. Kalau ada kesihatan, dijemput Allah, tapi tiada wang, tak sampai kita ke Mekah. Ada wang, dijemput Allah, tak ada kesihatan pun tak sampai kita ke Mekah. Paling hina ialah orang yang ada kesihatan, ada wang tapi tak dijemput Allah untuk ke Mekah. Itu akibat hati yang jahat dan hitam.”

Mari kita imbau kembali siapa yang rugi tidak dijemput Allah untuk menunaikan Haji akibat mudah mendengar fitnah tanpa mendengar kedua-dua belah pihak:

Comprehension Needed

Malaysians hardly read. Nor do they have the brain capacity to either process information or store information. This is why Malaysians have a very short attention span, memory retaining problem and are also gullible.

Example 1

When Malaysians read they have this superb speed-reading capability that they have used during their schooldays especially during last minute slogging sessions days before the SPM examinations. They will pick up key words, process these words in a crude manner that would make sense to only them and that forms their understanding.

So when the Attorney-General of the US Loretta Lynch conducted the press conference on the misappropriation of 1MDB sovereign funds, Malaysians pick up certain keywords, and they are:

Riza Aziz
Stepson
1MDB
Stolen
People of Malaysia
Malaysian Official 1

Simpletons put these six words together and they have a conjuncture that says “Malaysian Official 1 and stepson Riza Aziz together with 1MDB stole from the people of Malaysia.”

I would have termed them as nincompoops or morons but for the purpose of this article I’d like to make them sound like a bunch of professional morons – hence the use of the term simpletons.

The DoJ are applying for the seizure of assets “associated with an international conspiracy to launder funds misappropriated” from 1MDB.

This is about people who took money from funds meant for 1MDB to profiteer and for their personal consumption.

There are four people named in this civil forfeiture lawsuit and they are Riza Aziz who is the stepson of Najib Razak, Low Taek Jho, or Jho Low, and Abu Dhabi government officials Khadem al-Qubaisi and Mohamed Ahmed Badawy Al-Husseiny.

The four named above would now have to respond to the complaints filed in the lawsuit (show cause if you must, for the simpletons) to say to the DoJ that they purchased assets through legal means. This lawsuit can take up to seven years before it would come to a conclusion.

My point here is, dear simpletons, Najib Razak whom you have linked Malaysian Official 1 to be, is not named in this lawsuit. He is not a party to this process. Neither are 1MDB Official 1, 1MDB Official 2, and 1MDB Official 3.

Neither is anything missing or seized from 1MDB as 1MDB is also NOT a party to this civil lawsuit. In a larger scheme of things, it is 1MDB that is the victim of misappropriation and not a collusion partner to the four mentioned above.

(Note for Simpletons: please read this paragraph 50 times). As Malaysians also have problems retaining memory, it is important to remember that the criminal investigation by the Royal Malaysian Police into the administration and governance of the 1MDB based on the PAC report is still ongoing. This is the same PAC report that has cleared Najib Razak from any wrongdoing and was signed in absolute agreement by its members which includes DAP lawbreaker Tony Pua. To add to that, Najib Razak is not being subjected to any investigation as announced not only in Malaysia and the US, but also in Singapore and Switzerland and a couple other countries. (Simpletons now go back to the beginning of this paragraph).

Oh! Talk about having short memory:

Fatigue, mood swings, absent-mindedness all come with that dreadful word MENOPAUSE. It also comes with age. So if you are 64 and menopausal absent-mindedness probably comes as a double-whammy. That is why I can forgive Wan Azizah for her episodes of absent-mindedness.

She forgot that Najib Razak is not under any form of investigation or lawsuit, yet calls for Najib Razak to go on leave. Her absent-mindedness has made her forgot about one person whom have abused his position (much like her husband did prior to 1998) for personal gains and has actually been charged in a court of law! Did Wan Azizah call for this person to go on leave?

So, Wan Azizah is menopausal. But what has Tony Pua got to say for himself?

I don’t hear any call from Tony Pua asking Lim Guan Eng after the latter was charged in court. He can’t claim to be menopausal as he was born in Batu Pahat 44 years ago as was Guan Eng’s father, Lim Kit Siang. Furthermore, Tony is a man.

Or maybe not.

Lim Guan Eng had personally benefitted from the purchase of the bungalow on Jalan Pinhorn at a much lower price than its actual value. Using his position to interfere or influence the price of the bungalow. If he sells this bungalow tomorrow, then he would big making a huge some of money, thanks to his position as the Chief Minister of Penang that he has thus far been very reluctant to let go.

We are also still waiting for the documents pertaining to the proposed third Penang bridge that the Works Ministry has asked for. Let us also not forget about the RM305 million paid for a feasibility study for a RM6.3 billion tunnel linking Georgetown and Butterworth! RM305 million could have gotten the marginalised Chinese, Indian and Malay people of Penang 7,625 low cost affordable homes that would house at least 45,750 marginalised Penangites if they are priced at RM40,000 per unit!

So let us not digress from the main attention here which is the corrupted State Government of Pulau Pinang that is led by its Corrupted Minister Mr Lim Guan Eng who has been charged in court!

Najib Razak? Najib Razak has not done anything wrong as far as at least four nations are concerned and should just go about his business of developing the country as usual.
