Of late there have been calls for the return of Pulau Pinang to the sovereign Ruler of Kedah.  This is because since being governed by the DAP, Pulau Pinang (Penang) has been behaving like an autonomous state while chasing out Malays, Indians as well as marginalised Chinese from the island state.

If I were to follow my heart, I would wish for Kedah to reassert its sovereignty over Penang. However, legally that would be disastrous for Malaysia.

The History of the 

The proponents for the return of Penang to Kedah base their arguments on the agreement made in 1786 between the British East India Company and the Ruler of Kedah at the time, Sultan Abdullah Mukarram Shah.  During that time, Kedah was already under the Rattanakosin Kingdom established by King Taksin. Kedah was already paying tributes in the form of Gold Flowers to the Kingdom of Siam in 1781 and had accepted the Siamese sovereignty.

In the 1786 agreement, Francis Light was supposed to assist the Kedah ruler in the event that Kedah comes under attack by another power; the British East India Company (BEIC) was not to protect enemies of Kedah (namely the Burmese and Siamese); and BEIC was to pay the Kedah government an annual repariation of 30,000 Spanish Dollars for the lease of Penang.

Tension grew when Francis Light did not inform his superiors in India of the full details of what he had promised to Sultan Abdullah.  In the end, Light was asked to provide Sultan Abdullah with less than what had been requested. The EIC decided to to provide the Sultan with any form of protection and nothing was said of financial repariation.

Light was forced to use the island’s revenue to pay the Sultan but offered only $10,000 Straits Dollars a year for eight years for the island, or $4,000 Straits Dollars a year for so long as the Company occupied the island.

The unamused Sultan then gathered his forces in Prai in late 1790 to take Penang back by force which was defeated by Light. Sultan Abdullah sent his emmissaries Tunku Sharif Muhammad, Tunku Alang Ibrahim and Datuk Penggawa Telibun to negotiate a treaty with Light.

In 1791 a treaty called the Treaty of Friendship and Peace was signed between the BEIC and the Sultan of Kedah and the annual payment of a sum of 6,000 Spanish Dollars was promised to the Sultan for the rights to Penang and the two countries promised “to live in peace by sea and land, to continue as long as the Sun and Moon give light.”  BEIC was to no longer provide protection to Kedah against its enemies.  This treaty supercedes the treaty of 1786. (Dr Cheah Boon Kheng, former lecturer, History Department of the Universiti Sains Malaysia)

In 1800, another treaty was signed between BEIC and Sultan Ahmad Tajuddin Halim Shah II, the successor of Sultan Abdullah for the lease of Seberang Prai (called Province Wellesley then) for an annual sum of 4,000 Spanish Dollars that is to continue “as long as the Sun and Moon give light.”

From 1826, the BEIC placed Penang under the Straits Settlements. Subsequently, in 1874 the BEIC was dissolved and as a result of the 1873  East India Stock Dividend Redemption Act the Straits Settlements came under direct British Crown rule via its government in India.

The Brtish Government became the rightful owner of Penang as successor of the BEIC.

Towards The Independence of Malaya

Each state in what was called Malaya were sovereign states up until 31st August 1957 when the Federation of Malaya that existed following the breakdown of the Malayan Union in 1948 ceased to exist.

“Malaya” as it was known then was made up of the Federated Malay States (Selangor, Perak, Negeri Sembilan, Pahang), the Unfederated Malay States (Kedah, Kelantan, Terengganu, Perlis, Johor), and the Straits Settlements (Penang, Melaka and Singapore).

The discussions leading to the formation of the 1957 Federation of Malaya excluded Singapore in the equation.

During these discussions, both Melaka and Penang were referred to as the Crown Colonies whose people are citizens of Britain. The discussions involved Her Majesty Queen Elizabeth’s Government, the Nine Malay Rulers, and the Alliance government the people had elected to represent them.

In an early stage, it was agreed by both Her Majesty’s Government and the Nine Rulers that the office and person of the Yang DiPertuan Agong and the Queen would jointly administer the Settlements as “equal partners.”  According to this arrangement, the Queen would delegate her sovereign authority to the Yang DiPertuan Agong as the representative of the Queen and the Nine Rulers and that the Melaka and Penang would have a Governor appointed in consultation with the Straits Settlements’ office (CO1030/132(28) dated 16 August 1956).

This would be in line with protecting the Straits Chinese who were British subjects whose representation to the British government expressed fears that if Penang is administered by the independent Malayan government, they would be subjected to discrimination.

The British High Commissioner to Malaya, Sir Donald MacGillivray had already expressed grave doubts as to whether that arrangement would be accepted by the Alliance Party as the latter had wanted all the Settlements involved to be part of the newly independent and self-governing Malaya (CO1030/135 (2) dated 19 July 1956).

UMNO as represented by Tunku Abdul Rahman had also proposed that the provisions for Malay reservations in the proposed Constitution should be applied to Penang and Melaka.  However, this was met with stiff resistance by the British government. The Secretary of State said the proposal could “aggravate racial feeling”, adding that during the 180 years of British rule in the Settlements there had been no racial discrimination (CO1030/496 (8) dated 14 May 1957).

A compromise was proposed by the Rulers’ legal adviser, Neil Lawson, who suggested that one of the clauses on land reservations to include a provision to allow the State governments to set up a trust to buy land for the settlement of the Malays. This compromise was accepted by the meeting. This proposal was contained in Article 88 of the Federal Constitution allowing Parliament to modify the articles on land (Articles 83 – 87) for application in Penang and Melaka (Constitutional Proposals for Malaya, Cmnd, 210, op.cit).

If you noticed in all the above meetings not once did the Sultan of Kedah, Sultan Sir Badlishah ibni al-Marhum Sultan Abdul Hamid Halim Shah, discussed the return of Penang to Kedah as well as asserting His Royal Highness’s sovereign authority over Penang.

This demonstrates that Pulau Pinang and Seberang Perai were no longer legally part of the Kedah Sultanate.

However, what also almost happened was the return of Melaka to the Dutch.

On 16 May 1957, a newspaper Straits Budget reported that the Malayan Party under Tan Kee Gak had planned to ask the British Secretary of State about the Anglo-Dutch Treaty of 1824 in respect of Melaka.  According to Tan Kee Gak, Britain was planning to abandon Melaka to Malaya and as a contracting party was in breach of the said contract.  Therefore, Melaka should be returned to the Dutch instead of be part of an independent Malaya.

The Colonial Office viewed the report seriously and sought the advice of the Foreign Office which in turn sought the help of the government of the Netherlands to renounce such a claim explicitly (CO1030/439 (79) dated 20 June 1957).

Summary

I have no reservation whatsoever in expressing my disgust at the way Lim Guan Eng runs Penang and uses it in a very unMalaysian way.  But I doubt there is any legal avenue that would allow for the return of Penang to Kedah that would be undamaging to the country in its present legal form.  It would allow for parties in Melaka perhaps to ask Netherlands to reconsider claiming the state as its own based on the 1824 treaty, and Manila would have a legal precedence to follow in its claim on Sabah.

Not once did the Sultan Of Kedah from the days of Sultan Ahmad Tajuddin Halim Shah II through Sultan Abdul Halim Mu’adzam Shah have ever staked a claim on Penang.  This is simply because the treaties of 1791 and 1800 have superceded the one made in 1786.

And Penang’s current form is because of the 1957 Federal Constitution, cemented further by the 1963 Federal Constitution, agreed upon by all including by the Nine Malay Rulers without a single objection to its sovereign status. So how is it that Penang should be taken back by Kedah?

If the current claim is about the maruah (face/pride) of the Kedah Sultanate or about the pride of the Malays, that is just the mouth talking before the brain could think.

It would be nice to live dreaming about the day Penang becomes another district of Kedah but that is what the heart wishes. It is the legal and constitutional implications that have to be thought of thoroughly.

 

Bahri Stinks So Much Hell Might Also Follow Heaven And Reject Him

In my post yesterday  Noraihan Che Ali, Bahri Mohamad Zin’s second wife’s sister-in-law revealed that a team from Bahri’s Special Operations Division was sent from Putrajaya to raid her house and office confiscating documents pertaining to properties left by her late husband.

I have just been informed by friends in the legal profession that the Deputy Public Prosecutor who signed the Search Order was one Ahmad Sazilee bin Abdul Khairi.

I shall take a few steps back from that event.

DPP Ahmad Sazilee bin Abdul Khairi is not a nobody. He was seconded to the MACC from the Attorney-General’s Chambers (AGC) and resided in Bahri’s Special Operations Division.

In August 2015, Ahmad Sazilee was one of three persons from Bahri’s division who were arrested by police in connection with leaking the SRC International/1MDB investigation details to Sarawak Report.

Puzzling, they were all released on bail but never charged in a court of law.

Then in November 2015, the AGC announced that Ahmad Sazilee was pulled back to the AGC from the MACC.  He now resides in the Trials Unit of the AGC.


 How then could he on the 14th January 2016 sign a Search Order made under Section 31 of the MACC Act as  a DPP in the MACC when he was no longer there?


I wonder if the police investigating officer  (IO) is aware of the above facts? From what I learnt the investigation paper (IP) was only submitted to the AGC two weeks ago (a year after Noraihan made her first police report). The IP has been rejected by the AGC as the investigation was shoddy.

And then remember the pillow talk between Bahri and his loud-mouthed second wife where she shared all the details on Facebook? She was the one who filed the MACC report against her sister-in-law Noraihan.

The two should have been investigated under Section 8(1)(d)(iv) and (e)(iv) of the Official Secrets Act, 1972, and investigate the wife under Section 8(2) of the same Act.

To date, they have never been investigated nor charged in a court of law.

I wonder if Ahmad Sazilee’s sitting in the Trials Unit has anything to do with this.

As you remember in yesterday’s post it has been pointed out that Bahri’s division was formed to investigate high-profile cases of public interests and not some petty family property tussle.

Yet, Bahri’s division was sent from Putrajaya to Kota Bharu without the knowledge of the MACC Kelantan office.

For a MACC Search Order to be made there has to be an offence or offences committed under the MACC Act.

Whatever it is, the fact that Bahri’s second wife made the MACC report, Bahri allowing his division to raid Noraihan’s home and office, and a DPP no longer with the MACC signing a search order as a MACC DPP stinks awfully of a conspiracy to get their hands on RM100 million worth of properties.

If I were the IO whose IP was rejected by the AGC I would pluck the three from their cage and grill them.

And I would start with Ahmad Sazilee bin Abdul Khairi.

Bahri Stinks To High Heaven

In April 1999, Anwar Ibrahim was sentenced to six years imprisonment for abusing his power as the Deputy Prime Minister to coerce witnesses to retract their statement against him.

Bahri Mohamad Zin, the former Director of Special Operations of the Malaysian Anti Corruption Commission (MACC) who apparently leads a ‘master and servant‘ lifestyle with his wife Noor Haslina Abdullah as the master, did the very same thing on the 18th January 2016.

A team from the MACC’s Special Operations Unit was dispatched from Putrajaya to raid the house of Noor Haslina’s widowed sister-in-law Noraihan to seize documents linked to a dispute involving Noor Haslina and the latter.

This was revealed by Noraihan Che Ali at a media conference today. Noraihan was accompanied by her lawyer Datuk Ahmad Zaharil Muhaiyar.


Noraihan said that she and her children moved out of their house after it was seized by the MACC.

Noraihan added that both Noor Haslina and Bahri had tried to get her (Noraihan) to sign a document agreeing to give up her rights and her children’s rights to the properties estimated at RM100 million left by her late husband.

Prior to the raid, Noor Haslina and Bahri had tried to obtain an agreement from Noraihan and her children to forgo their rights to the properties. They even tried to force Noraihan’s nine-year old son to get his thumbprint for the said document.

Noraihan’s lawyer Datuk Ahmad Zaharil also revealed that Noor Haslina and Bahri had doctored a will to exclude Noraihan and family from receiving any property.

“This is a family matter, why should there be an involvement of the MACC? And it has been a year since the raid was made, don’t tell me they need such a long time to investigate (the documents),” asked Datuk Ahmad Zaharil.

“And Noor Haslina should go to a court of law to obtain a power of attorney to administer Allahyarham Zamly’s properties instead of using high-handed methods,” he added.

Noraihan lodged two police reports last year which were first revealed to the public in an article posted by Malaysia Today early this month.

Both reports have not been acted upon seriously by the Royal Malaysian Police (PDRM) especially on the part of abuse of power. The use of government apparatus to achieve one’s own goals is no different to what Anwar Ibrahim did and was jailed for.

Noraihan said that she and her family continuously live in constant fear as threats and harrassment have become a daily occurrence.

She revealed that she almost did not turn up for the press conference due to constant harassments including from people representing Noor Haslina.

So it seems that Bahri who constantly portrays himself as a God-fearing, no-nonsense man, stinks to high heaven and would do anything for his wife in order to deny orphans their right to their late father’s properties.

The use of MACC apparatus for his own personal interest is a clear indication of his willingness to abuse his position to achieve his ends.

PDRM must act upon her reports while the MACC has to conduct an internal investigation or else there will be those who have the potential to continuation tarnish the good name the MACC is currently having under this current administration.

The Director-General of the Protection Division of the Prime Minister’s Department should also look into providing Noraihan Che Ali with a witness protection program given the continuous threats and harrassments they receive.

When he wore his tuxedo to his James Bond themed birthday ball, YABhg U-Turn Mahathir did not turn up as Bond himself, but rather as one of the antagonists in the James Bond movie, Francisco Scaramanga. While Scaramanga used a golden gun to kill others, Mr Scare-a-monger here uses a golden pen.

In his reply to HRH Sultan of Johor Scare-a-monger pointed out that the bulk of purchasers of the Forest City properties are the mainland Chinese and that would cause that part of Johor to have “an inordinate percentage of foreign people.”

When Scare-a-monger launched the ‘Malaysia My Second Home (MM2H)’ programme in 2002, an inordinate percentage of foreign people did come to Malaysia to purchase properties.  Some even opened up companies to help facilitate their countrymen to own properties in Malaysia like Mr Ishihara Shotaro who is now a Malaysian permanent resident after being in Malaysia since 1992 and owns quite a number of properties around Malaysia.  Ishihara says that the dropped in the Ringgit is like a twenty percent discount for the Japanese on all properties in Malaysia.

As a matter of fact in October 2015 Nomura reported that Malaysian properties remain in Japanese firms’ sight.  And this was before the drop in the Ringgit.

So, when mainland Chinese property buyers come over to take advantage of Scare-a-monger’s MM2H programme, why is he crying foul?

It would also be a matter of time for Mr Ishihara Shotaro to be able to become a Malaysian citizen if he wishes to do so – thank you to Scare-a-monger’s MM2H programme.

Scare-a-monger also forgot to mention that when he wanted the Petronas Twin Towers (KLCC) built, foreign companies built it – namely Hazama Corporation from Japan for Tower One and Samsung Engineering and Construction for Tower Two.  In fact although Ekovest led the construction for the KLIA, foreign companies became the consultants.

Scare-a-monger also went on to say that when foreigners take a loan to buy properties here, they take loans from local banks.  Therefore, there is no capital inflow from abroad.  Is he saying that foreigners can take up loans without having to have an account opened at local banks but locals do?

And if a bank account is required, do these foreigners go to Bank Negara to wait for newly-minted notes to be given to them for free so they could open up bank accounts here to get a loan? So where do they get money from to open bank accounts if not by bringing in from abroad?

And when he says a foreigner can buy property in China and get one flat or house free in Malaysia, no profit will be made in Malaysia, therefore no taxes will be paid to the Malaysian Government, can he tell me how is it possible for the Chinese developer in China to give free house in Malaysia for the buyer in China without first purchasing the house in Malaysia?  If these houses can be given for free to foreigners, why not give away some of these houses to Malaysians?

Scare-a-monger is getting old. Time is nearly up for him and he fears that when he dies, there would not be enough bank notes to cover his grave when others are contented to have earth fill up theirs.

So all he does is shoot off his golden gun and see what gets hit.

The only thing is he has so far been firing blanks just to scare people.

 

Wahyu Tokong

Saya suka bila tokoh-tokoh pembangkang bersuara atau membuat janji-janji yang mereka ketahui tidak akan ditepati.

Sebagai contoh di atas, Ketua Menteri yang telah didakwa sebagai korup di dalam mahkamah berjanji bukan sahaja untuk menghapuskan GST yang telah banyak membantu negara semasa kemurungan ekonomi global malah menghapuskan kutipan tol Lebuhraya Utara-Selatan serta Jambatan Pulau Pinang Pertama.

Penghapusan kutipan tol tersebut akan menelan belanja sekitar RM30 bilion wang pembayar cukai untuk membayar pemegang konsesi lebuhraya tersebut.

Perjanjian konsesi lebuhraya-lebuhraya di Malaysia dibuat semasa di bawah pentadbiran Pemerintah Parti Pribumi Bersatu Malaysia, U-Tun Mahathir Mohamad.

Ini juga bermakna wang para pembayar cukai di negeri Sarawak yang bakal menerima sebuah lebuhraya bebas tol akan turut digunakan untuk membuat pembayaran tersebut.

Saya agak teruja ingin mengetahui apa perasaan rakyat terutamanya para pembayar cukai negeri Sarawak mengenai janji yang dibuat oleh Lim Guan Eng itu.

A Birthday Story

My father after receiving his Doctorate of Law honoris causa from his alma mater the University of Buckingham in March 2012

He was born 78 years ago and named after the man whom had helped made the marriage between my grandparents possible.

Although he was the apple of his father’s eye, he was brought up to be independent as quickly as possible – a method you and I would later understand as you continue to read this story.

At seven, his father said to him “Haniff! Tomorrow you go to the school and enrol yourself. If anyone asks, just tell them you are Omar’s son!”

Alone my father went; and because others had their parents with them, no one saw Haniff. As the school was about to be closed for the day, the teacher saw him sitting alone and asked, “Who are you and why are you here?”

“I am Omar’s son,” he replied.

“Good God!” the teacher exclaimed. “Why didn’t you tell me earlier?”

One day, his father said, “Haniff, a week from now you will not have any backbone.” My father didn’t know what that meant.

His father worked at the district office and was the Billiards Champion. A week later he was going to defend his title.

Earlier that night, the family had dinner together. After dinner, his father walked down the stairs to his bicycle, ready to leave for the Billiards Club.

My father went after his father and wished, Good luck, Dad!”

My grandfather looked up, smiled and replied, “Thank you, son. Where I’ll go I will need all the luck.”

His father suffered a heart attack defending his title. Exactly a week after the prophetic message he told my father.

When my 13-year old father heard the news he ran barefooted to look for his father first at the hospital, then at the Billiards Club. He saw his father being laid down on the bench with onlookers encircling.

The last time he held his father’s hand when his father was alive was inside the ambulance when a hand dropped and my father lifted it back up.

My father never left the side of his father’s body inside the mortuary, and slept very little for fear that someone would take the body away while he was asleep, and for fear that he might miss the opportunity to be with his father for the last time.

As a result he became insomniac, sleeping three hours a day at most, till now. His insomnia allowed him to read and read.

From that point onwards he was the man of the house, and had to be independent.

And that led him to be who he is today.

Happy 78th birthday, Ayah. I can never top the greatest way a son could ever love his father the way you love yours but I love you with all my heart nevertheless.

Thank you for being the greatest father this son could ever have.

Pembohong Bersiri Kembali Lagi

Juara Pembohong Bersiri, Rafizi Ramli pada hari Ahad telah memulakan siri pembohongannya kepada warga FELDA di Sungkai.  Di dalam majlis tersebut Rafizi berkata kepada lebih kurang 300 orang yang hadir pada malam tersebut bahawa hutang FELDA kian bertambah dan kerajaan akan menggunakan wang peneroka untuk melangsaikan hutang tersebut.

Saya masih menunggu laporan polis mengenai FELDA yang dijanjikan oleh Rafizi Ramli.  Dua Khamis berlalu sudah namun salinan laporan polis pun masih belum kelihatan. Masakan sesuatu yang begitu penting bagi kesejahteraan warga peneroka FELDA khususnya dan rakyat Malaysia amnya boleh dilupakan Rafizi?  Bagaimana jika saya katakan bahawa Rafizi langsung tidak mempunyai niat untuk membantu warga FELDA dan apa yang diwar-warkan oleh beliau hanya pembohongan semata-mata?

Jangan kita lupa, pada tahun 2016 sahaja beliau telah empat kali didapati bersalah di mahkamah dan pernah juga disabitkan dengan kesalahan memfitnah sebelum-sebelum ini:

Pembohongan Rafizi mengenai FELDA hanyalah bersandarkan laporan kewangan FELDA bagi tahun-tahun 2013 dan 2014.  Beliau mencanangkan bahawa pada tahun 2013 FELDA telah kerugian sebanyak RM1.9 bilion manakala pada tahun 2014 pula kerugian yang dialami FELDA adalah sebanyak RM1 bilion.

Sudah tentu warga FELDA akan melompat.  Ini menunjukkan betapa teruknya pengurusan FELDA hingga mengalami kerugian sepanjang masa.  Namun, adakah itu gambaran sebenarnya?

Ini adalah sebab Rafizi hanya bercerita mengenai 2013 dan 2014.

Apa yang Rafizi tidak cerita ialah pada tahun 2011 FELDA telah membuat sedikit keuntungan iaitu sebanyak RM174.15 juta tetapi telah membuat keuntungan sebanyak RM5.757 bilion. Kita boleh lihat juga pada barisan yang pertama, pendapatan FELDA telah meningkat selama empat tahun berturut-turut termasuk pada tahun-tahun yang dicanangkan oleh Rafizi.

Begitulah jahatnya Rafizi. Kerugian dia cerita. Keuntungan disenyapkan. Asalkan kemarahan warga peneroka ditimbulkan hanya untuk memenuhi cita-cita politik keji beliau.

Keuntungan yang diperolehi FELDA pada tahun 2012 adalah akibat penyenaraian FELDA Global Ventures (FGV) pada tahun tersebut. Perjanjian Pajakan Tanah FELDA selama 99 tahun oleh FGV juga menentukan sebanyak RM250 juta dibayar kepada FELDA setahun.  Dalam pada itu, FGV juga dikehendaki berkongsi 15% keuntungan pengoperasian yang diperolehinya dengan FELDA.

Ini bermakna secara keseluruhannya tidak kira sama ada FGV meraih keuntungan atau mendapat kerugian, FELDA tetap akan menerima RM250 juta campur 15% keuntungan pengoperasian FGV.  Itulah sebabnya pada baris pertama rajah di atas anda boleh lihat pendapatan FELDA kian meningkat.

Bagaimana pula dengan kerugian dua tahun berturut-turut?

Sebagai sebuah badan berkanun, FELDA menggunakan standard perakaunan asas tunai yang diubahsuai dan bukan perakaunan akruan tulen yang digunapakai oleh syarikat-syarikat swasta.  Disebabkan itu penanaman semula kelapa sawit dan juga kebajikan berupa perumahan untuk warga FELDA adalah dikira sebagai perbelanjaan.

Ini ditambah pula dengan penurunan harga minyak sawit mentah (Crude Palm Oil Price) pada tahun-tahun tersebut.

Penanaman semula adalah amat penting bagi menentukan kesinambungan kesejahteraan para peneroka FELDA. Pokok yang tua tidak dapat memberi jumlah pengeluaran yang dikehendaki.

Apabila penekanan terlalu diberikan oleh seorang mantan Perdana Menteri kepada pembinaan mercu tanda seperti KLCC,pengeluaran kereta yang merugikan dan lain-lain, penanaman semula kelapa sawit tidak dilakukan maka pada tahun 2009 kita dapat lihat penurunan pengeluaran minyak sawit di rajah yang dikeluarkan oleh Amerika Syarikat di atas.  Di sebabkan faktor inilah pokok-pokok tua tidak lagi mampu mengeluarkan buah sebanyak yang diperlukan.

Akibatnya pendapatan FELDA dan para peneroka terjejas.

Kita dapat lihat pada tahun 2012, lebih 50% pokok kelapa sawit adalah berusia lebih 21 tahun (ditanam lewat tahun 1980an dan permulaan 1990an).  Disebabkan kelapa sawit adalah merupakan tanaman saka, kesan akibat tiada penanaman semula dijalankan secara agresif hanya dapat dilihat kini, iaitu dalam zaman pentadbiran Najib Razak.

Pun begitu, langkah-langkah penanaman semula telahpun dijalankan di bawah pentadbiran Najib Razak untuk menentukan pendapatan untuk FELDA dan para penerokanya akan terus bertambah.  Ini dapat dilihat dari penurunan jumlah pokok berusia lebih 21 tahun dan penambahan pokok-pokok berusia di antara 0-3 tahun hingga 4-9 tahun.

Maka, janganlah dipercayai pembohongan Rafizi Ramli.  Anda bersusah sedikit sekarang untuk meraih keuntungan yang lebih di masa hadapan.  Sudah memang menjadi tugas Rafizi untuk berbohong dan menghasut rakyat membenci kerajaan.  Itu yang diakuinya sendiri.

Kemudian beliau boleh pula bertanya kenapa beliau dipenjarakan sedangkan beliau hanya melawak?

After being exposed lying about the Klang Valley Mass Rapid Transit (which I will soon be writing about just to further leave this liar totally naked), Rafizi the Legally-Certified Serial Liar has promised a ‘huge expose‘ on FELDA.

This exposé, like the others before it, will just be another blow job performance by the serial liar, not a whistleblower job as it does not fall within the requirements of the Whistleblower Act.

Therefore it is just a meaningless exposé meant only to fluff his readers and followers.

If my memory serves me right, he promised on the 27th December 2016 to make a police report on Najib Razak and the FELDA Board Members on the 29th December 2016. It is three days short of a fortnight since he made that promise that has yet to be fulfilled.

So we all know what that means. He needs more time to plan his next lie.

When he blows it, only a group of people would like false enjoyment. Most would just treat it with disgust.

Tanggang Bin Ali Buat Hal Lagi

Siapa ingat kisah di atas? Baru lebih empat tahun dulu Azmin di anggap seperti Si Tanggang oleh ibu kandungnya sendiri.

Namun, kesemuanya kelihatan baik dan sempurna setelah Azmin menjadi Menteri Besar setelah Abdul Khalid Ibrahim digulingkan oleh rakan-rakan separtinya sendiri melalui Kajang Move.

Sejak itu, Azmin dilihat menjadi semakin lantang bersuara terutamanya dalam usaha memburukkan kerajaan pusat.


Azmin sebenarnya ingin mengukuhkan kedudukannya untuk menghadapi serangan dari dalam parti terutamanya dari kem Wan Azizah. Oleh sebab itu beliau perlu menunjukkan betapa beliau lebih layak menjadi presiden partinya berbanding Wan Azizah yang tiada sebarang pengalaman selain menjadi tempat Anwar Ibrahim meletakkan kakinya semasa duduk berehat.

Mungkin Azmin telah mendapat restu ibunya dan telah berbaik semula dengan adik-beradiknya.

Malang sekali bagi Che Tom Yahaya yang berumur 82 tahun dan kini sakit teruk, kejatuhan matawang Ringgit yang dibuat bising oleh Azmin bermakna beliau wajib bercuti di London untuk Boxing Day sales kerana ianya lebih penting dari kesihatan ibu kandungnya itu.

Lihat sahajalah luahan adiknya Ummi Hafilda.


Patutlah negeri Selangor ni semakin parah keadaannya. Menteri Besar hanya pentingkan dirinya sendiri.

Majlis Perbandaran Klang Ditadbir Oleh Bangkai?

Adakah pentadbiran Majlis Perbandaran Klang (MPK) dilakukan oleh sekumpulan bangkai?

Saya nyatakan sebegini kerana pentadbiran MPK menyalahkan pihak Polis DiRaja Malaysia kerana tidak menghalang pihak MPK, selaku penganjur Fiesta Gegar Klang di Kompleks Sukan Pandamaran, daripada mengadakan pertunjukan bunga api sempena sambutan Malam Tahun Baru.

Pertama sekali, larangan pembakaran mercun dan bunga api masih berkuat kuasa. MPK sebagai sebuah pihak berkuasa tempatan (PBT) juga pasti mengetahui mengenai perkara ini.

Keduanya, sebagai sebuah PBT MPK harus mempunyai prosedur-prosedur yang tetap mengenai penganjuran sesuatu majlis atau pertunjukan sama ada yang dianjurkan di kawasan-kawasan milik MPK oleh penganjur luar mahupun oleh MPK sendiri.

Sudah tentu sebagai penganjur Fiesta, pihak MPK arif dengan prosedur-prosedurnya sendiri. Ini termasuk menyemak lesen mengimpot dan kelayakan menggunakan bunga api yang diberi oleh Kementerian Dalam Negeri untuk pertunjukan kepunyaan kontraktor yang dipertanggung jawabkan untuk membuat pertunjukan tersebut.

Sekiranya mereka tiada memiliki lesen mengimpot mahupun kelayakan membakar bunga api tersebut mereka boleh didakwa mengikut Seksyen 4(2) Akta Bahan Letupan 1957 yang jika sabit kesalahan, boleh dihukum penjara lima tahun atau denda RM10,000 atau kedua-duanya.

Maka, adakah MPK telah berlaku secara tidak bertanggung jawab memberi kontrak pertunjukan bunga api kepada sebuah syarikat yang tidak berlesen?

Ketiga, sebagai penganjur juga MPK bertanggung jawab menentukan jarak selamat di antara kawasan pembakaran bunga api tersebut dengan kawasan para penonton. Dari segi perundangan, MPK mempunyai duty of care untuk menentukan keselamatan para pengunjung di premis miliknya itu.

Keempat, kita semua tahu mengenai larangan pembakaran bunga api dan mercun yang masih berkuat kuasa. Kalau membakar mercun skala kecil oleh individu menjadi kesalahan, mustahil MPK berfikir tidak perlu memohon sebarang permit untuk pembakaran bunga api pada skala yang besar.

Orang yang pemikirannya normal sudah tentu akan memeriksa dengan kontraktor bunga api tersebut bukan sahaja berkenaan lesen, sijil kelayakan yang dinyatakan di atas, tetapi juga permit untuk mengadakan pertunjukan bunga api tersebut.

Hanya bangkai yang tidak berupaya berfikir sedemikian.

Maka, alasan mengatakan pihak PDRM yang menjadi sebahagian dari jawatankuasa Fiesta adalah amat daif. Saya berani katakan bahawa pihak PDRM dijemput hadir untuk kawalan trafik dan bukannya terlibat dengan tatacara perjalanan Fiesta tersebut.

Kalau saya seorang peguam yang mahu mengukir nama, dengan segera saya akan adakan khidmat guaman pro bono buat mereka yang tercedera mahupun yang mengalami trauma mental akibat kejadian tersebut dan saman pihak MPK dalam satu class action. Kes ini memang kes tentu menang.

Tak usahlah pihak MPK nak salahkan orang lain. MPK adalah penganjur, maka MPK sahajalah yang bertanggung jawab di atas kejadian tersebut.
